TERMS AND CONDITIONS OF AUCTION

General

1. By entering the Auction you agree to be bound by the full terms and conditions of entry.


2. Entry into the auction is deemed acceptance of these terms and conditions.


3. The promoter is Australian Rainforest Foundation ABN 44073434563 (ARF) of Suite 1b, 51 Esplanade, Cairns, Queensland, Australia 4870, Tel +61 7 4051 2000 ('Promoter').


4. Any personal information collected will be used for the purposes of promoting ARF and auction product suppliers only, unless where entrants have elected not to receive such material. Entrants' personal information will not be passed on to any third party.


5. Commencement of the Auction is 26 July 2010.


6. The Auction closes at 5pm AEST 5th August 2010.


7. The result of the auction is final and no correspondence will be entered into. The winner will be notified by e-mail and phone, within 2 days of the Auction Date.


8. Unclaimed Auction prize. The successful bidder has three (3) months to claim their prize.


9. The Prize is subject to the availability of any supplier for the components of the Auction including but not limited to accommodation, tour and airline operators which may not be available during certain periods, such as Australian public holidays.


10. Taxes, fuel surcharges & levies, unless specified, are not included and must be paid for by the winner.


11. Other than stated inclusions, the Prize does not include laundry or any other items of a personal nature.


12. The Promoter reserves the right to request that the winner provide proof of identification prior to receiving the prize. Proof of identification considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize.


13. Directors, management, employees (and their immediate families) of the Promoter and their respective related body corporate, and the registered travel companions of employees of the Promoter and their related body corporate, are not eligible to enter this Auction.


14. The Promoter takes no responsibility for non Australian residents, who may require a visa to enter Australia. The granting of an entry visa is subject to normal Australian immigration laws and is the responsibility of the competition entrant to ascertain if a travel visa will be granted.


15. The Promoter is not responsible for any problem or technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.


16. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner (and their nominated travel companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.


17. If for any reason the promotion is not capable of running as planned (including but not limited to as a result of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.


18. The Promoter, its related body corporate, and their respective officers, employees, contractors and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect or consequential loss) suffered or sustained in connection with this promotion, the marketing of this promotion or the use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).


19. Auction details remain the property of the Promoter.


20. These Terms and Conditions are governed by the laws of the State of Queensland and the Commonwealth of Australia which are in force in Queensland. The Promoter and winner submit to the exclusive jurisdiction of the Courts of Queensland, relevant Federal Courts and Courts competent to hear appeals from them.

The Prize

1. The Prize must be taken by 30 November 2010.


2. The Prize is transferable at the discretion of the Promoter. The winner may elect to nominate a person or persons to take the Prize in their place and the Promoter may at their sole discretion agree to award the Prize to the nominee(s).


3. The Prize is not exchangeable for other goods and services and cannot be redeemed for cash.


4. The air travel consists of two (2) adult return Economy tickets with the Airline nominated by the Promoter, departing from the winner's nearest serviced port on the nominated airline's global network (not code share service) for arrival in Australia and onwards travel to Cairns.


5. Fourteen (14) night's accommodation during the prize period of day 1 to day 15 for 2 people on a twin/double share basis at one (1) or more of the participating accommodation properties.


6. Other selected tour, travel and dining components of the prize as listed on the competition web site, as may be reasonably taken within the constraints of travel time and product availability during the prize period.


7. Includes the opportunity to plant a native Australian Rainforest Tree at one of the Promoter's conservation sites.


8. The maximum total prize value is AUD $35,000 and is based on the recommended retail value of the elements of the prize at the time of printing. The value of the prize will also vary depending on the winner's point of origin. The Promoter accepts no responsibility for any variation of the value of the prize.


9. The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. Each element of the prize may only be used on the date (and, if applicable, at the time) stated for that element of the prize. Any element of the prize that is unused will be forfeited.


10. Unless agreed by the Promoter, the prize does not include stopovers other than stated, hotel car parking, other hotel incidentals, airport transfers or other ground transportation other than stated, taxes not included in the price of the ticket, visas, passports, travel or other insurance, gratuities, merchandise or any other costs of a related, ancillary, personal or incidental nature not stated. Compliance with any health or other government requirements, other travel documentation and any extras of a personal nature (including without limitation tips, telephone, and laundry charges) are the responsibility of the winner and their nominated travel companion.


11. The winner and their nominated travel companion cannot upgrade any prize travel or prize accommodation using cash, unless agreed at the sole discretion of the Promoter. If for any reason the winner does not take an element of the prize during the stated period, and on the conditions stipulated by the Promoter (and those of any prize supplier), then that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize.


12. Bookings must be made at least 60 days before departure date and will be made by the Promoter or his nominated agent or prize supplier.


13. The Promoter takes no responsibility for any interruption, variation or cancellations of itinerary, other travel or accommodation arrangements resulting directly or indirectly, but not limited to, acts of God, acts of government or authorities breakdown in vehicles or related machinery, incidents at sea, war or civil unrest, medical or customs regulation and other dangers. Furthermore, the Promoter also makes no representation as to the safety, conditions or other issues that may exist at any destination. If such an event arises, the Promoter is not required to compensate the winner.
